1. General Provisions

1.1. The online store EasyGreen, available at easygreen.store, is operated by EasyGreen ITC Dawid Adach with its registered office at Kijowska 7/49, 03-738 Warsaw, Tax ID: PL8341798109, , hereinafter referred to as the “Seller”.

1.2. These terms and conditions are directed at Consumers and define the rules and procedure for concluding a Distance Sales Agreement with the Consumer through the Store.

2. Definitions

2.1. Consumer – a natural person entering into a legal transaction with an entrepreneur not directly related to their business or professional activity.

2.2. Seller – EasyGreen ITC Dawid Adach with its registered office at Kijowska 7/49, 03-738 Warsaw,.

2.3. Customer – any entity making purchases through the Store.

2.4. Store – the online store operated by the Seller at easygreen.store

2.5. Distance Contract – a contract concluded with the Customer as part of an organized system of concluding distance contracts, without the simultaneous physical presence of the parties.

4. Technical Requirements

4.1. To use the Store, including browsing the Store’s assortment and placing orders for Products, the following are required:

a) an end device with Internet access and a web browser such as , Chrome, Firefox, Safari etc.
b) an active email account,
c) cookies enabled,
d) FlashPlayer installed.

5. General Information

5.1. The Seller shall not be held liable, to the fullest extent permitted by law, for any disruptions in the functioning of the Store caused by force majeure, unauthorized action of third parties, or incompatibility of the online Store with the Customer’s technical infrastructure.

5.2. Browsing the Store’s assortment does not require creating an account. Placing orders by the Customer for Products in the Store’s assortment is possible either after creating an account or by providing necessary personal and address data enabling the Order to be processed without creating an account.

6. Rules for Placing Orders

6.1. To place an Order, you should:

a) select the Product that is the subject of the Order and then click the “Add to cart” button;
b) fill in the Order Form by entering the recipient’s details and the address for delivery of the Product;
c) select the type of shipment (method of delivery of the Product);
d) enter invoice details if different from the recipient’s details;
e) choose one of the available payment methods and, depending on the payment method, pay for the order within the specified time.

7. Offered Delivery Methods and Payments

7.1. The Customer can use the following delivery methods or pickup of the ordered Product:

a) Postal shipment,
b) Courier shipment,

7.2. The Customer can use the following payment methods:

a) Bank transfer to the Seller’s account
b) Electronic payments
c) Payment by credit card.

7.3. Detailed information on delivery methods and acceptable payment methods can be found on the Store’s website.

8. Execution of Sales Agreement

8.1. The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has previously placed the Order using the Order Form in the online Store.

8.2. After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution occurs by sending an appropriate e-mail message to the Customer’s provided email address.

8.3. The Sales Agreement is concluded when the Customer receives the e-mail message referred to in point 8.2.

8.4. The term of the sales agreement: the agreement is concluded for a fixed period necessary to fulfill the order, its delivery, and any complaint or return process.

9. Right to Withdraw from the Contract

9.1. The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.

9.2. The period specified in clause 1 begins from the delivery of the Product to the Consumer or to a person designated by them other than the carrier.

9.3. The Consumer may withdraw from the Agreement by submitting a statement of withdrawal from the Agreement to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the statement before the expiry of this period.

9.4. The statement may be sent by traditional mail, fax, or electronic mail by sending the statement to the Seller’s e-mail address – the Seller’s contact details are specified in point 3.

10. Complaints and Warranty

10.1. The Sales Agreement covers new Products.

10.2. In the event of a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the provisions concerning warranty in the Civil Code.

10.3. The complaint should be submitted in writing or electronically to the Seller’s addresses provided in these Terms and Conditions.

10.4. It is recommended that the complaint include, among others, a brief description of the defect, the circumstances (including the date) of its occurrence, the Customer’s data submitting the complaint, and the Customer’s request in connection with the defect of the goods.

11. Out-of-court Complaint Handling and Dispute Resolution

11.1. Detailed information on the possibility for the Consumer to use out-of-court complaint handling and claim pursuit methods, as well as the rules of access to these procedures, are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, and at the following internet addresses of the Office of Competition and Consumer Protection:

11.2. The Consumer has the following exemplary possibilities of using out-of-court complaint handling and claim pursuit methods:
a) The Consumer is entitled to apply to the permanent consumer arbitration court referred to in Art. 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to resolve a dispute arising from the Agreement concluded with the Seller.
b) The Consumer is entitled to apply to the provincial inspector of Trade Inspection, pursuant to Art. 36 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.
c) The Consumer can obtain free assistance in resolving the dispute between them and the Seller, also using the free assistance of the poviat (municipal) consumer ombudsman or social organization whose statutory tasks include consumer protection (including the Consumer Federation, Polish Consumer Association).

11.3. At http://ec.europa.eu/consumers/odr, there is an online platform for resolving disputes between consumers and entrepreneurs at the EU level (ODR platform). The ODR platform is an interactive and multilingual website with a one-stop-shop for consumers and entrepreneurs seeking out-of-court resolution of a dispute regarding contractual obligations arising from an online sales or service contract.

12. Personal Data in the Online Store

12.1. The administrator of Customers’ personal data collected via the online Store is the Seller.

12.2. Customers’ personal data collected by the administrator via the online Store is collected for the purpose of implementing the Sales Agreement, and if the Customer consents – also for marketing purposes.

12.3. The recipients of Customers’ personal data from the online Store may be:
a) In the case of a Customer who uses the delivery method of postal shipment or courier shipment in the online Store, the Administrator provides the collected personal data of the Customer to the selected carrier or intermediary carrying out shipments on behalf of the Administrator.
b) In the case of a Customer who uses electronic payment methods or credit card payment in the online Store, the Administrator provides the collected personal data of the Customer to the selected entity servicing the above payments in the online Store.

12.4. The Customer has the right to access their data and correct it.

12.5. Providing personal data is voluntary, but not providing the personal data indicated in the Terms and Conditions necessary to conclude a Sales Agreement results in the inability to conclude such an agreement.

13. Final Provisions

13.1. Agreements concluded through the online Store are concluded in Polish.

13.2. The Seller reserves the right to make changes to the Terms and Conditions for important reasons, that is: changes in law, changes in payment and delivery methods – to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller will inform the Customer about each change at least 7 days in advance.

13.3. In matters not regulated in these Terms and Conditions, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on Provision of Electronic Services; the Consumer Rights Act, the Personal Data Protection Act.

13.4. The Customer has the right to use out-of-court means of dealing with complaints and pursuing claims. To this end, they may submit a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
